In South Carolina, most slip-and-fall claims must be filed within 3 years of the injury. This deadline is set by the state’s statute of limitations for personal injury cases. If you miss it, the court will likely dismiss your case. Claims involving government-owned property may have shorter notice requirements, which is why acting early is crucial.

What if I didn’t report the fall right away?

Not reporting the incident immediately does not kill your claim, but it gives the insurance company room to attack credibility. They’ll argue the hazard didn’t exist or that your injuries came from something else.
